2. Description of Services

[Company Name] provides a specialized B2B and B2C digital recruitment and placement platform that connects international educators with accredited schools, academies, and educational institutions, primarily in Morocco and internationally.

Nature of Relationship:

  • We act strictly as an intermediary recruitment technology platform and talent consultancy.
  • We are not an employer, temporary work agency, or party to any employment contract executed between a Candidate and a Partner School, unless expressly agreed under a separate managed services contract.
  • Any contract of employment or engagement resulting from the use of our services is strictly between the Candidate and the hiring Partner School.

3. Account Registration & User Eligibility

A. General Requirements

  • Users must be at least 18 years of age and possess full legal capacity to enter into binding agreements.
  • You agree to provide accurate, current, and complete information during registration and keep your account profile updated.

B. Account Security

  • You are responsible for maintaining the confidentiality of your account credentials (username and password).
  • You must immediately notify us at [legal@yourcompany.com] if you suspect any unauthorized access to or breach of your account security.

4. Terms Applicable to Candidates (Teachers & Educators)

A. Verification & Accuracy of Information

Candidates warrant that all information, documents, and credentials submitted—including Curriculum Vitae (CV), academic degrees, teaching certifications, background checks, employment history, and references—are true, accurate, and genuine. Submitting falsified documents or fraudulent information will result in immediate profile termination and potential legal action.

B. Reference & Background Authorizations

By submitting an application through our platform, Candidates authorize [Company Name] and partner schools to:

  • Verify academic credentials with issuing universities or certification bodies.
  • Contact listed professional references.
  • Require official background checks, police clearance certificates, or child safety declarations as required by Moroccan law or school policies.

C. No Guarantee of Placement

Submission of an application or registration on our platform does not guarantee job placement, an interview, or a job offer from any Partner School.

5. Terms Applicable to Partner Schools & Employers

A. Legitimate Job Vacancies & Non-Discrimination

Partner Schools warrant that all posted vacancies represent genuine, active employment opportunities. Schools agree to comply with applicable labor laws and shall not discriminate based on race, gender, nationality, religion, age, or disability beyond bona fide occupational or legal visa requirements.

B. Confidentiality of Candidate Data

Partner Schools receive candidate dossiers solely for evaluating prospective employment. Schools agree to handle all candidate data confidentially and in strict compliance with applicable privacy laws and our Privacy Policy.

C. Non-Circumvention & Direct Hiring

If a Partner School is introduced to a Candidate through our platform, database, or recruitment team, the school agrees not to engage or hire that Candidate directly outside the platform to bypass applicable placement fees or contractual terms set forth in the separate Master Services Agreement (MSA) between [Company Name] and the School.

6. Child Safeguarding & Final Vetting Disclaimer

Child safety is paramount in educational recruitment:

  • Our Role: We conduct preliminary document screening and candidate interviews in good faith.
  • School Responsibility: The ultimate legal obligation to conduct final background checks, verify police clearances, validate original diplomas, conduct final interviews, and secure required Moroccan work permits or visas rests solely with the hiring Partner School.
  • Limitation: [Company Name] shall not be liable for any acts, omissions, conduct, or representations of candidates once placed with a school.

7. Intellectual Property Rights

  • All platform content, software, logos, trademarks, design elements, text, and database architecture belong exclusively to [Company Name] or its licensors.
  • Users are granted a limited, non-exclusive, non-transferable license to access and use the platform solely for recruitment and employment search purposes.
  • Scraping, automated data extraction, reverse engineering, or reproducing platform content without express written consent is strictly prohibited.

8. Fees and Payments

  • For Candidates: Registration, profile creation, and job application submission through our standard candidate portal are free of charge.
  • For Partner Schools: Fees for recruitment services, candidate introduction, job postings, or premium vetting are governed by individual commercial proposals or Master Service Agreements executed with each institution.

9. Prohibited Conduct

Users agree not to:

  • Submit false, misleading, defamatory, or fraudulent profiles or job postings.
  • Use the platform to send unsolicited commercial communications (spam).
  • Upload viruses, malware, or malicious code designed to disrupt platform security.
  • Harvest or collect personal data of candidates or school representatives for unauthorized commercial purposes.

10. Limitation of Liability

To the maximum extent permitted under Moroccan law:

  1. “As-Is” Service: The platform and services are provided on an “as-is” and “as-available” basis without warranties of any kind, whether express or implied.
  2. Indirect Damages: [Company Name] shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or employment opportunities, arising out of your use of the platform.
  3. Total Liability: In any event, our maximum aggregate liability arising from these Terms or use of the services shall be limited to the total fees paid by you to [Company Name] in the three (3) months preceding the claim, or 1,000 MAD, whichever is greater.

11. Suspension & Termination

We reserve the right to suspend, disable, or terminate any User account or access to the platform immediately, without prior notice, if:

  • You breach any provision of these Terms.
  • We reasonably suspect fraudulent, deceptive, or unlawful activity.
